1. Who We Are and Scope

Highpoint Foundry, Inc. (“Highpoint Foundry,” “we,” “us,” or “our”) is a Wyoming corporation. This General Privacy Policy explains how we collect, use, disclose, and retain personal information in connection with our corporate websites, business communications, customer relationships, and general company operations (collectively, “Corporate Services”).

Our individual products and services, including ADSB.co and business-to-business data services, have their own privacy policies that describe their specific data practices. Product accounts are independent; there is no single Highpoint Foundry account shared across all products. When you use a particular product, review its product-specific privacy policy. This General Privacy Policy does not replace those notices.

2. Information We Collect

Depending on how you interact with us, we may collect:

  • Contact and business information: name, email address, organization, job title, and other information you provide when contacting us or conducting business with us.
  • Account-related information: account identifiers and administrative or customer records associated with a particular business relationship. Product-specific account data is further addressed by the relevant product privacy policy.
  • Billing and transaction information: billing contact details, invoices, purchase and subscription history, transaction identifiers, payment status, and related records. Payments may be handled by multiple third-party providers; their collection and handling of payment credentials are governed by their own policies and the applicable product notices.
  • Communications: messages, support inquiries, feedback, and related correspondence.
  • Technical and security information: IP addresses, browser and device information, request timestamps, server and security logs, and information needed to maintain and protect our websites and systems.
  • Cookies and local storage: information stored in your browser where necessary for website functionality, preferences, or security. We do not currently deploy advertising or remarketing tracking on our corporate websites.
  • Other information: information you voluntarily provide or that we lawfully receive in the course of our business operations.

We do not collect all of these categories from every person.

3. Sources of Information

We obtain personal information directly from you, automatically from browsers and devices interacting with our websites or systems, and where relevant from payment processors, service providers, business counterparties, and publicly available sources.

4. How We Use Information

We use personal information to:

  • Operate, maintain, administer, and secure our Corporate Services and self-hosted infrastructure.
  • Respond to inquiries, provide support, and communicate with customers and business contacts.
  • Manage accounts, contracts, subscriptions, payments, invoices, and business records.
  • Detect fraud, prevent abuse, investigate incidents, and troubleshoot technical issues.
  • Meet legal, tax, accounting, regulatory, and contractual obligations.
  • Establish, exercise, or defend legal claims and enforce applicable agreements.

We do not currently use website analytics services or advertising and remarketing platforms on our corporate websites.

5. Cookies and Tracking

Our corporate websites do not currently use website analytics services, advertising pixels, or remarketing platforms. We do not currently operate a cookie-consent banner or preference-management tool.

Our websites may use essential cookies or browser storage for functions such as security, session management, and remembering preferences. You can manage or block cookies using your browser settings, although blocking essential storage may affect website functionality.

If we introduce nonessential cookies, advertising tracking, or remarketing technology in the future, we will update this Policy and implement any consent, notice, and opt-out mechanisms required by applicable law before deploying that technology.

6. Disclosure of Information

We may disclose relevant personal information to:

  • Payment providers that process purchases, subscriptions, or other transactions.
  • Service providers that assist with email, communications, support, security, and other operational functions. Our primary infrastructure is self-hosted, but some external services may still be used.
  • Professional advisers, including legal, accounting, and financial advisers.
  • Public authorities or other parties where disclosure is required by law or reasonably necessary to protect legal rights, safety, or security.
  • Successors or transaction participants in connection with a proposed or completed merger, acquisition, restructuring, financing, or asset transfer, subject to applicable law.

We do not currently disclose personal information to advertising or remarketing platforms for targeted advertising through our corporate websites. If these practices change, we will update this Policy and provide applicable privacy choices before beginning the new processing.

7. Data Retention

We do not apply a single fixed retention period to all personal information. We retain information for as long as reasonably necessary for the relevant operational or business purpose, including customer support, account administration, billing, security, compliance, recordkeeping, and dispute resolution.

Retention periods depend on the type of information, its purpose, applicable legal obligations, and whether a continuing business relationship or dispute exists. When information is no longer needed, we delete, deidentify, or otherwise dispose of it as appropriate, subject to lawful exceptions and practical backup retention cycles.

8. Security

We use reasonable administrative, technical, and organizational safeguards appropriate to the nature of the information and risks involved. Our primary infrastructure is self-hosted. No system or transmission method can be guaranteed completely secure. Where required by law, we will notify affected persons and authorities of qualifying security incidents.

9. Your Privacy Rights

Depending on your location and the applicable law, you may have rights to request access to, correction of, or deletion of personal information; obtain a portable copy; object to or restrict certain processing; withdraw consent; or opt out of certain sales, sharing, or targeted advertising where such processing occurs. You may also have rights to appeal a denied request or lodge a complaint with a supervisory authority.

To exercise a right, email support@hpfd.net with the subject Privacy Request. Describe the request and, if relevant, the product or service involved. We may request information reasonably necessary to verify your identity or authority. We will respond within the time required by applicable law and will not unlawfully discriminate against you for exercising your rights.

Where applicable, we honor legally required browser-based opt-out preference signals and authorized-agent requests. We do not currently use corporate-website advertising or remarketing trackers. Certain rights are subject to legal exceptions, including requirements to retain records for tax, security, contractual, or legal purposes.

Our services may be accessed worldwide. We are based in the United States, and personal information may be processed in the United States or in other countries where our providers operate. Privacy laws and protections may differ between countries. Where required, we use appropriate safeguards for international transfers.

Where laws such as the EU or UK General Data Protection Regulation apply, our legal bases for processing may include performance of a contract, compliance with legal obligations, our legitimate interests in operating and securing our business and communicating with customers, and consent where required. The applicable basis depends on the particular processing activity. You may contact us for more information about a specific activity.

11. Children

Our Corporate Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13 through Corporate Services. If you believe a child has provided personal information, contact support@hpfd.net. Individual products may have additional age restrictions and disclosures in their own policies.

12. Product-Specific Policies and Third Parties

Each Highpoint Foundry product may use different infrastructure, vendors, account systems, data sources, and processing practices. Its separate Privacy Policy governs those product-specific activities. Links to independent third-party websites or services are subject to their respective privacy notices. We are not responsible for independent third parties’ practices except as required by law.

13. Changes to This Policy

We may update this Privacy Policy to reflect changes in our practices, technology, or legal obligations. We will publish the updated version at https://policy.hpfd.app/privacy with a revised date and provide additional notice or obtain consent when required by law.
